Agreement to Terms
Welcome to JobContinue. By accessing or using our platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services. These terms constitute a legally binding agreement between you and JobContinue.
Eligibility
You must be at least 18 years old to use JobContinue. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement. If you are using JobContinue on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
- Not create multiple accounts or share your account with others
- Not use another person's account without permission
We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.
User Conduct
You agree not to engage in any of the following prohibited activities:
- Posting false, misleading, or fraudulent information on your profile or resume
- Harassing, threatening, or discriminating against other users
- Spamming, phishing, or sending unsolicited commercial messages
- Impersonating another person or entity
- Violating intellectual property rights of others
- Uploading malicious code, viruses, or harmful software
- Scraping, crawling, or using automated tools to access the platform
- Attempting to gain unauthorized access to our systems or other users' accounts
- Interfering with the proper functioning of the platform
- Using the platform for any illegal or unauthorized purpose
Job Seeker Responsibilities
If you are using JobContinue as a job seeker, you agree to:
- Provide truthful and accurate information about your skills, experience, and qualifications
- Keep your resume and profile up to date
- Respond professionally to recruiter inquiries and interview requests
- Honor commitments made to potential employers
- Not misuse the platform to collect company information for competitive purposes
Recruiter Responsibilities
If you are using JobContinue as a recruiter or employer, you agree to:
- Post only legitimate job opportunities with accurate descriptions
- Comply with all applicable employment and anti-discrimination laws
- Respect candidate privacy and use their information only for recruitment purposes
- Not misrepresent your company or the nature of the job opportunity
- Provide timely feedback to candidates who have applied or interviewed
- Not use the platform to collect candidate data for purposes other than hiring
Content Ownership and License
You retain ownership of the content you submit to JobContinue (resumes, profiles, course materials, etc.). By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for the purpose of operating and improving our services.
All platform features, design, code, and branding are the exclusive property of JobContinue and are protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of our platform.
Payment and Subscriptions
JobContinue offers both free and paid subscription plans. By subscribing to a paid plan:
- You authorize us to charge your payment method on a recurring basis
- Subscription fees are non-refundable except as required by law
- You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period
- We reserve the right to change pricing with 30 days' notice
- Failed payments may result in suspension of premium features
Creator Monetization
If you participate in our Creator program to offer courses, mentorship, or workshops:
- You must provide high-quality, original content that delivers value to learners
- JobContinue retains a platform fee (as specified in your Creator agreement) from your earnings
- Payouts are processed according to our payment schedule and minimum threshold requirements
- You are responsible for any applicable taxes on your earnings
- We reserve the right to remove content that violates our quality standards or policies
Disclaimers
JobContinue is provided "as is" without warranties of any kind. We do not guarantee:
- That you will find a job or hire a candidate through our platform
- The accuracy, completeness, or reliability of user-generated content
- Uninterrupted or error-free operation of the platform
- That our AI matching algorithms will produce perfect results
- The quality or legitimacy of job postings or candidate profiles
You acknowledge that employment decisions are made solely by employers, and JobContinue is not responsible for hiring outcomes or workplace disputes.
Limitation of Liability
To the maximum extent permitted by law, JobContinue, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or ₹1,000, whichever is greater.
Indemnification
You agree to indemnify and hold harmless JobContinue from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your violation of these terms, your use of the platform, or your violation of any rights of another party.
Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for violations of these terms or for any other reason. Upon termination, your right to use the platform ceases immediately. You may also delete your account at any time through your account settings.
Dispute Resolution
Any disputes arising from these terms or your use of JobContinue shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English in Bangalore, India. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Governing Law
These Terms of Service are governed by the laws of India. Any legal action or proceeding shall be brought exclusively in the courts of Bangalore, Karnataka, and you consent to the jurisdiction of such courts.
Changes to Terms
We may modify these terms at any time. We will notify you of material changes via email or platform notification at least 15 days before they take effect. Your continued use of JobContinue after changes become effective constitutes acceptance of the revised terms.
